Adoption by the UNCITRAL of the Model Law on the Use and Cross-border Recognition on Identity Management and Trust Services

The United Nations Commission on International Trade Law (UNCITRAL) adopted the “Model Law on the Use and Cross-border Recognition on Identity Management and Trust Services,” a model law developed by the Working Group IV – Electronic Commerce, chaired by Professor Giusella Finocchiaro since 2014.
The model law is the first text that addresses on an international level the issue of digital identity and is the fruit of the seeds that were sown more than ten years ago, as work on identity management and trust services has first been proposed in New York. Since then, it has become evident that this matter lies at the core of the digital economy and the model law may be used to facilitate interaction between existing and future regional models and schemes.
Since Professor Finocchiaro is the Chairwoman of the Working Group IV – Electronic Commerce, two other projects have already been adopted: the Notes on the Main Issues of Cloud Computing Contract and the Model Law on Electronic Transferable Records, endorsed by G7 and adopted in many countries, the European States included.

55th UNCITRAL Working Session

The 55th session of the United Nations Commission on International Trade Law (UNCITRAL), in which Prof. Avv. Giusella Finocchiaro will take part, is currently underway in New York. In fact, the focus of the working session will be the draft of the “Model Law on the Use and Cross-border Recognition of Identity Management and Trust Services,” the model law that will allow in a cross-border context the use and recognition of digital identities and trust services internationally. The law was drafted by the Working Group IV - Electronic Commerce, under the leadership of the Professor as the Chairwoman of the group.
